Back in August, Sean Higgins killed Johnny Gaudreau and Matthew Gaudreau during a car accident while the brothers were back home for their sister's wedding.
The Gaudreaus were riding their bikes when Higgins' car swerved into their lane, leading to a fatal incident.
Subsequently, Higgins was arrested and charged with vehicular homicide and aggravated manslaughter. Moreover, it was revealed that his BAC level at the time was .087.
He eventually pled not guilty to these charges even though the prosecution was offering a plea deal.
According to NJ.com, Higgins' legal team is now preparing a motion to have the case thrown out completely. Among his arguments for this is that the Gaudreau brothers were allegedly drinking prior to the accident.
The legal team claims that the Gaudreaus had higher BAC levels than Higgins. However, they are also refusing to blame the Gaudreaus for a crash.
It remains to be seen whether or not this strategy is going to work out for Higgins. The man claims that the public opinion on the matter is hindering him from a fair trial, and that is another reason for the motion.
We cannot imagine what the Gaudreau family must be feeling right now, especially in light of what Higgins is alleging here.
